The website operating at the address https://www.bird-publisher.com/ (hereinafter: Online Bookshop) is owned and operated by Benjamin Plut - Samozaložba Bird Publisher, shortened name Bird Publisher, with its address at Loka 77, 4290 Tržič, Slovenija, registered at Furs, Kranj Ljubljana (for selfpublishers at the time of this Terms and Conditions special Register in Slovenia did not exist), Tax No.: 51456826. Under Slovenian law (ZDDV-1) we are not a DDV (VAT) taxable person.
The Seller is a legal person who issues an invoice for ordered Books or/and eBooks, as well as prepares and dispatches goods to the Customer
The Customer is a natural or a legal person who orders goods in writing (in the Online Bookshop system via e-mail) or orally (in person or by phone), and consequently enters into a purchase agreement with the Seller, i. e. receives an invoice from the Seller.
The Customer and the Seller must both respect these General Terms and Conditions. A purchase agreement is stored at the headquarters of the Seller, and can be accessed only by authorized persons. The Customer has the right to return goods, without giving any reason, within fifteen (15) days from the date of delivery.
By placing an order, the Customer accepts the present General Terms and Conditions.
Physical products (printed Books) can be ordered in two ways:
- by placing an order in the Online Bookshop system,
- by placing an order via e-mail: info(at)bird-publisher(dot)com
- by phone
- or personal.
After receiving the order, confirmation of order acceptance and further instructions shall be sent to the Customer via e-mail.
Ownership of the goods remains with the Seller and does not pass to the Customer until the Customer pays the price of the goods (and other related sums including any transportation costs if not agreed othervise) and accepts the goods.
The goods are delivered via mail or courier service. They can be also delivered in person, if the Customer and the Seller appoint a personal meeting for goods delivery.
3.2.1 E-book Order Methods
E-book can be ordered via the Online Bookshop system. The Customer has to create a user account ("My Account"). E-books are delivered into the “Downloads” section. E-books cannot be ordered without having a user account.
An account for a new Customer can be created at the Register Account page. Returning Customer can log in at the Login page.
After receiving the order, confirmation of order acceptance and further instructions shall be sent to the Customer via e-mail.
After receiving the payment, the e-book is delivered into the “Downloads” section in Customer’s user account (My Account). The Customer may download the purchased e-book three (3) times. Original invoice for the e-book (PDF) is sent via e-mail. Invoice can Customer also download from "My Accunt/Order History".
Free of Charge sample eBooks (0,00€)
Please check the box “Free of charge” as a payment method, so that the order can be finalized.
A tip for the Kindle reader users: E-books can be converted from EPUB format into MOBI or AZW3 with the Calibre free open-source programme.

3.2.2 License Terms
All e-books in the online bookstore are copyrighted.
Immediately after making your purchase of an e-book, you accept a license agreement, by which you agree to comply with the terms and conditions below. The license agreement is concluded for an indefinite period of time or as long as you have the e-book or e-books that you purchased on this website and downloaded from “My Account”, “Downloads” section.
By purchasing, you obtain a license to use a specific e-book exclusively for personal use and are allocated 3 downloads of the purchased ebook from the Online Bookshop. Each e-book in our store is protected by soft DRM protection.
“Copyright” license: without the prior written permission of the rights holders, the e-book may not be transferred to other websites, reproduced, distributed, processed or otherwise used in part or in whole in any way.
If you would like to give the book to someone, please purchase an additional copy. Thank you for respecting the copyright and our efforts in preparing the e-book for you to read.
In practice, the above means the following:
- you are allowed three (3) downloads from the “Downloads” section (My Account)
- you can use the e-book on various personal devices, such as e-readers, tablets, smartphones, laptops, and the like.
- e-books may not be given away or given to other people in any way
- downloading e-books to other websites, reproducing e-books, distributing them, modifying them, or using them in any other way than specified in this license agreement is not permitted.
Any violation of these license terms is a legal offense, for which liability for damages is provided at a minimum.
3.2.3 E-book Protection
All e-books that you can buy in our online store have soft DRM protection added.
Soft DRM protection means that each e-book contains a unique encrypted code. The code is invisible to the user, so it does not interfere with the reader when reading, but it is encrypted and cannot be changed or removed. This unique encrypted code contains information about the buyer of the e-book, which allows traceability and identification of the buyer in the event of a license violation and/or unauthorized use of the purchased e-book.
Responsibility for violations of the license terms lies exclusively with the buyer, and information about the latter is written on the pages of each e-book separately.
Product prices are stated in euros (EUR), which is also stated on each invoice received by the buyer.
Prices are stated excluding VAT, because Bird Publisher Self-Publishing House (seller) (abbreviated name: "Bird Publisher") is not liable for VAT in accordance with paragraph 1 of Article 94 of the ZDDV-1.
Prices stated for individual books or e-books are stated excluding delivery costs. Delivery of books throughout the Republic of Slovenia is free of charge, except in the case of selecting the "Cash on delivery" payment method.
The buyer receives an invoice from the seller after making a purchase. If the buyer is a legal entity and wants an invoice with a tax number or VAT identification number, they must state the full name of the legal entity, registered office and postal address when ordering, and add the appropriate tax number.
4.2.1 Physical Books

Payment by a bank transfer: The Customer receives an e-mail with detailed information, and makes a bank transfer to the account specified in the e-mail. Goods are shipped after receiving payment.
Cash on delivery (in Slovenia only!): Purchase price is charged at the time of delivery by mail or by post / courier service.
Payment on cash on personal acceptance (in Slovenia only!): Purchase price is collected at the personal acceptance of goods from the Seller.
4.2.2 E-books
We accept the following payment methods for e-books:

Payment by a bank transfer: The Customer receives an e-mail with detailed information, and makes a bank transfer to the account specified in the e-mail. E-book is delivered into “Downloads” section of the Customer’s user account (My Account), usually in 1–2 days after receiving payment. The original invoice is sent by e-mail.
Free-of-charge e-books (0,00€): Please check “Free of charge” sample eBook option in the form, in order to finalize the order.
4.2.3 Cost of Delivery
Delivery is possible only in the Republic of Slovenia.
The cost of postage for delivering books within Slovenia is free for the buyer, except in the case of payment upon receipt as mentioned above.
For purchases with delivery outside the borders of Slovenia, prior notice must be given by e-mail. In the reply, we will inform you whether delivery is possible or how much the delivery costs will be. If you then decide to purchase, you will receive a separate invoice for delivery costs. Only after payment of these costs and at the same time the purchase of the book has been made, will we also send you the books. Orders for books with delivery outside the Republic of Slovenia will be cancelled and canceled without prior notice by e-mail.
The estimated cost of delivery within the European Union is approximately €12 - depending on the weight of the shipment and the delivery address.
There are also no shipping and delivery costs for e-books, as you will receive them in your “My Account”/“Downloads” section after making the purchase, from where you can download them as above.
4.2.4 Invoicing
A Seller issues an invoice for each order in our bookshop, in accordance with information provided by a Customer in the order form. An invoice is sent by e-mail (PDF) or in a shipment, together with the ordered goods.
4.2.5 Secure Purchase
Our business partners ensure the security of payments made. Our website is protected by an SSL security certificate, which enables encrypted transmission of information. You exchange data with our server via a secure connection (https). Payments are made on the website of our business partners, who ensure the success of the payments made.
Regardless, we recommend that you be careful when making online purchases. It is better to double-check where you provide your personal information. At least check the address bar of your browser to see if you are really on the website you intended to go to.

Physical printed books that are in stock shall be shipped off as soon as possible, usually the next day, but no later than in five (5) working days from receiving the order, respectively no later than three (3) days after payment receipt.
Information on the total order value appears after the Customer chooses the method of payment and delivery.
Goods are delivered to the address specified by the Customer in the order form.
The Seller is not liable for delays arising after transferring the delivery to the post office or courier services.
E-books are delivered free of charge, into the “Downloads” section of the Customer’s user account (My Account).
How to download an e-book to your device?
Log in to your user account in the Online Bookshop system (Login).
Locate the “Downloads” in your account (My Account) (in the left under the “My Order” category, or right in the shortcut column).
Click the call icon with the “Download” icon. (The number of downloads is limited, each e-book can be downloaded no more than three times.)
How to read an eBook?
Ebooks in EPUB format can be read on every e-reader. (E-books can be converted from EPUB format into MOBI or AZW3 with the Calibre free open-source programme.).
If you do not have an e-reader, you can read ebooks on your computer, tablet or smartphone. In order to do that, you need to install one of the free applications for ebook reading, for example:
Computer: Adobe Digital Editions (Windows) or Calibre (Win / Mac / Linux) or Kitabu (Mac), etc.
Tablet or smartphone (Android, iOS): eg. PocketBook Reader etc. are available in the Google Play store or. Apple App Store.
If for any reason we are unable to fulfill your order in full, we will notify you as soon as possible via email or call you, so you can decide to cancel the order and receive a refund or order another book.
We reserve the right to exceptionally cancel the order if the stock of books runs out at the time of your order. We can also arrange for you to receive the selected book as soon as it becomes available again. In any case, we will notify you immediately by email or call you.
In accordance with Article 43 of the Consumer Protection Act (ZVPot-UPB2, Official Gazette of the Republic of Slovenia, No. 98/2004 of 9 September 2004), the buyer has the right to withdraw from the contract within fifteen (15) days of receiving the goods.
The latter can be done in writing by e-mail to our address info(afna)bird-publisher.com or by returning the purchased books to our address.
The buyer is not obliged to state the reason for withdrawing from the purchase, but must return the received goods unused and undamaged in the original packaging and in the unchanged quantity no later than fifteen (15) days after receiving the package or from the day on which he notified us in writing of his withdrawal from the contract.
The original invoice must be enclosed with the shipment, and the bank account number must also be stated in the covering letter. In the case of undamaged books received, we will refund the purchase price to your account.
If you, as a buyer, withdraw from the order/contract, you will be responsible for the cost of returning the package you received, according to the Consumer Protection Act (paragraph 6, Article 43.č), and the seller is not obliged to refund you.
In the case of e-books, a refund is no longer possible after the purchase has been made. In the case of a damaged downloaded e-book file, please inform us and we will send you a working or undamaged one.
A complaint may include a damaged package, a book with an obvious defect, such as missing pages in the book.
We accept complaints and claims in writing to the e-mail address info@bird-publisher.com. Please include your name and surname in the message, specify the defect and state your bank account number, to which we will refund your purchase price in the event of a correct complaint.
Send the damaged goods together with the invoice and the reason for the complaint to our address.
Send the shipment to us by regular mail, as we will not accept damaged goods sent cash on delivery.
We will review your possible complaint as soon as possible, but no later than fourteen (14) days from the receipt of your package. In the event of a correct complaint, we will refund your purchase price. As a seller, we only bear the costs of sending the complained book if the complaint is submitted correctly.
If the complaint is not resolved satisfactorily, you can send us a complaint within fifteen (15) days. In the event of any misunderstanding, we will undoubtedly be able to reach an agreement to the benefit of both parties.
